OP, I would not be hasty about sending the rifle back to Henry. I have the 30-30 with the peep sights, and yes, I have occasionally had my lever pop open.
I have remedied this with a combination of things. First, watch the Henry instructional videos on how to properly load the rifle. Second, pay attention to the overall length of your cartridges. Shorter tends to be better. Lastly, I mostly just load one less than the maximum it holds. I’m not going to battle with my 30-30, so it really makes no difference.
My rifle is a tackdriver, has an excellent trigger, and the sights are not something I’d want to give up.
